1. Cuthbertson Laird Group, the owners, will hire the items described for the period and rentals shown. In the event of no period of time being specified, either party may terminate the hiring by giving seven days notice.
2. The charge for such hire will be the rates in the price list as agreed. All equipment supplied comes with Cuthbertson Laird Group certificate of conformance. Calibration certificates will be charged at current company list price. Delivery and collection charged at cost.
3. The hire commences on the day the equipment is delivered to the hirer and continues until the equipment is received at any of our depots in the UK.
4. The hire period is one seven consecutive day, week inclusive. The hirer may retain equipment for longer than one week without notice to the owner. This extended period will be for complete weeks. Any period less than one week will be treated as full week for invoicing purposes.
5. The hirer will in its use of the said equipment observe all the maker's Instructions and other regulations that may be issued for the proper use of thereof and shall be entirely responsible for any damage caused to the said equipment through failure to observe such instructions or regulations.
6. It will be the hirer’s responsibility:
a. Not to subject the said equipment to any misuse or unfair wear and tear and to use it in a proper manner.
b. To preserve the owners or manufacturers identification numbers or marks of any nameplate that there should be on the side equipment.
c. To keep the equipment safe from damage and in good condition whilst the equipment is in the hirer’s possession.
d. To identify the owner in respect of loss or damage to the equipment however caused except for fair wear and tear and normal use. In the event of any damage, theft or loss, the hirer shall notify the owner immediately, who will quote a reasonable sum covering the cost of repair or replacement, plus any loss of rate will continue until the owner has been paid in full the amount of the sum said.
e. In the event of the equipment being found defective, on receipt or during use, the company must be notified immediately and we will replace or repair with the minimum possible delay.
7. The hirer will not without previous consent of the owner, sell or offer for sale, mortgage, pledge, lend or otherwise dispose or part with the possession of the items or any of them.
8. The hirer will not hold the owner responsible for any loss, damage or injury (including death) to property or persons with regard to use of equipment hired.
9. In the case of default of payment the owners are entitled to recover the said equipment without prior notice being given.
10. In the event of equipment being for use abroad or in a hazardous environment, it is the responsibility of the hirer to arrange adequate insurance cover to the full replacement value of the said equipment and to provide a copy of the certificate of insurance to the owners.
11. Settlement terms are strictly net within 30 days from the date of the invoice. The company reserves the right to impose an interest charge on overdue accounts.
12. Any consumables ordered extra to the item ordered will be charged at current company list price.
Cuthbertson Laird Group reserves the right to change specifications and/or prices without notice. |
